Website owner, the offering, and binding of Terms


This website is owned and operated by Taylor and Kong LTD. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors an online store, blogs, product recommendations and links to our social media accounts. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

 

Who can use your website; what are the requirements to create an account


In order to use our website and/or receive our services, you must be at 18 years of age, or of the legal age of majority in your territory, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

 

Key commercial Terms offered to customers


When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

Please insure that when placing an order your full address is correct, giving clear property name/number and postcode/zipcode; if the information you have given is incorrect, resulting in lost of goods, the responsibility falls to the customer. At our discretion, we cannot replace, refund or resend products lost due to inaccurate information provided at the point of purchase, by purchasing product from us you agree to these terms.

·       If goods are returned to us due to inaccurate information, you will be charged the re-delivery cost.

·       If goods are returned to us due to inaccurate information, and you do not wish them to be sent back out, we can offer you a refund for goods only, not for shipping.

If items have been sent back to use due to being left at the post office or parcel force outlet longer than the 14 days they give for holding, we can not be responsible for resending you items, you will be charge again for postage if you require your items. If you do not want the items anymore then we can only refund the cost of the goods, not the cost of shipping.

 

If an order is placed we can only hold the items for 14 days, this may happen due to us receiving incorrect information leading to us not to be able to ship your order, in this eventuality we will try our best to contact you, however, if we do not hear back within the 14 days of the order being placed well will have to refund the money and cancel your order.

Offers

 

Offers cannot be retro added to orders, so ensure that you meet the required specifications for the offers when purchasing.

Offers cannot be back dated including pre-orders, offers are only valid if placed during the offer start and end dates specified.

Promo codes cannot be retro applied, so insure you have typed in the code if you plan to use one, we cannot add them after the order has been placed.

Return and refund policy (UK only)


chinandchoo.com has a 7 day returns window in accordance to the UK Distance Selling Regulations. All items being returned will be at your own expense unless faulty or sent in error. This return window excludes perishable (fresh and frozen) items (please see above). If, for any reason, you wish to return any items, you should:

  • Contact us via email contact@chinandchoo.com If we receive any returned goods without our prior knowledge we reserve the right to refuse them.

  • Once you have notified us of your wish to return an item, the item(s) should be sent back to us with a copy of the delivery note or receipt at: Ziangs HQ, Mart road, Minehead, Somerset, TA24 5BJ

  • All products must be returned sealed and in a saleable condition unless faulty or defective. We recommend that you return items using recorded delivery as we cannot assume responsibility for anything you send back until we have received them.

  • Once we have processed your return you will be refunded the cost of the item(s) being returned.

Please follow the returns instructions above. The processing of returns is at the discretion of chinandchoo.com. Should you not follow the guidelines laid out in this notice, we reserve the right to apply a processing charge proportional to any additional work required to process the return. We are happy to process returns beyond the 7 days if:

  • A product was found to be faulty or damaged.

  • A product was sent in error.

Once we have received the goods back, we will give you a full refund including delivery costs incurred if a refund is asked for, or we will endeavour to replace your product with the same or similar item and reimburse you with delivery costs. Should no substitute for the product be found a full refund will be issued. Returns of products bought on promotion will be refunded at the promotional price. Please allow 10-15 days (not including delivery time) for us to process your return.

If you haven't received your order after 10 working days, contact us asap, as after 30 days we cannot do anything about.

We can not refund an order if it has been marked as delivered by the currier, this also applies to international orders.

We cannot refund personalised items, i.e signed cooked books with personal messages,

If parcels are refused by the addresse you will be liable to still pay for the postage, so we can only refund the cost of the goods, if you want your items you will have to pay for postage again, however if the parcel was retunred to us due to the parcel being in poor condition, we can ship a new one back out at no extra cost or issue a full refund.

DENTED CANS: As most of our stock is normally sold to trade, tins more often than not will come in dented as they are not concerned about how good they look, if you receive a dented can, we can not resend or fund you for this, as its still usable, unless the tin is unusable or if the contents of the tin has been affected then we will of course do our best to make sure you're happy. We would never send out a product that is fit for use.

International orders

We can only ship the cookbook world wide, currently we are not able to send food items.

NOTE: . We can not be held liable due to damage during transit. We are not responsible for any orders lost in transit once they have left our care and have been handed to the delivery service. We also are not liable for any import costs (tax etc.)

We can only refund the cost of the item, not your shipping, we can only refund when we receive the goods back, you are responsible for paying shipping for the return.

Retention of right to change offering


We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Ownership of intellectual property, copyrights and logos


The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of [Taylor and Kong LTD]. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

 

Right to suspend or cancel user account


We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification


You agree to indemnify and hold [Taylor and Kong LTD] harmless from any demands, loss, liability, claims or expenses (including legal fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability


To the maximum extent permitted by applicable law, in no event shall [Taylor and Kong LTD], be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, [Taylor and Kong LTD] assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

You agree to receive from time to time promotional messages and materials from us, by email or any other contact form you may provide us with (excluding your phone number for calls or text messages). Preference of law and dispute resolution


These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [The United Kingdom], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in [The United Kingdom].
